Welcome to The Wedding Center at Flower Patch. These Terms of Service (“Terms”) govern your use of weddingflowerpatch.com, as well as floral products, rental items, consultations, delivery, setup, and other services provided by Flower Patch (“Flower Patch,” “we,” “our,” or “us”).
By accessing our website, submitting an inquiry, scheduling a consultation, placing an order, making a payment, or using our services, you agree to these Terms and our Privacy Policy.
1. Our Products and Services

The Wedding Center at Flower Patch provides wedding-related products and services that may include:

• Custom bridal and bridesmaid bouquets

• Corsages, boutonnieres, and floral accessories

• Centerpieces, ceremony flowers, and reception arrangements

• Wedding arches, backdrops, and decorative installations

• Budget-friendly floral collections

• Bulk and DIY wedding flowers

• Wedding décor and equipment rentals

• Floral consultations, delivery, setup, and pickup

Product availability, pricing, service areas, delivery options, and scheduling are subject to change.

2. Consultations and Estimates
Consultations, proposals, and estimates are based on the information available at the time they are prepared. Unless otherwise stated in writing, an estimate does not reserve products, flowers, rental items, services, or an event date.
Your order or event date is considered confirmed only after all required agreements have been accepted and any required deposit or payment has been received.
Changes to your floral selections, quantities, event location, delivery schedule, or event details may result in additional charges.

3. Flower Availability and Substitutions
Flowers and greenery are natural, seasonal products. Their availability, color, size, shape, and appearance may vary due to growing conditions, weather, shipping, seasonality, and wholesaler availability.
We make every reasonable effort to follow your selected color palette, style, and overall design. However, we cannot guarantee the availability of a particular flower variety or exact color.
When necessary, we may substitute flowers, greenery, containers, ribbon, or related materials with items of a similar color, style, quality, or value. Substitutions will be made with the intention of preserving the overall design and appearance of your order.
Images displayed on our website, social media pages, proposals, and inspiration boards are examples only. Because each arrangement is handcrafted and natural products vary, completed designs may not be identical to reference photographs.

4. DIY and Bulk Flower Orders
DIY and bulk flowers are provided as fresh, bulk-cut products and may arrive in their natural, unprocessed form. Processing, trimming, arranging, storage, hydration, transportation, and care may be the customer’s responsibility unless otherwise agreed in writing.
Some varieties are seasonal and may only be available in certain colors or quantities. We recommend placing DIY and bulk orders at least two weeks before the requested pickup date, although availability is not guaranteed.
Once DIY or bulk flowers have been picked up or delivered, Flower Patch is not responsible for damage, deterioration, or loss caused by improper handling, storage, temperature, transportation, hydration, or environmental conditions.

5. Pricing and Payments
Prices displayed on the website are subject to change and may not include delivery, setup, installation, pickup, taxes, rental deposits, venue-related fees, or other service charges.
Payment schedules, deposits, final-payment deadlines, and accepted payment methods will be stated in the applicable proposal, invoice, order confirmation, or service agreement.
Orders may not be processed or confirmed until the required payment has been received. Flower Patch reserves the right to suspend or cancel an order or service for nonpayment.
Unless otherwise stated in writing, deposits and payments are applied toward products, materials, labor, preparation, scheduling, and inventory reserved for your event.

6. Order Changes and Cancellations
Requests to change an order must be submitted as early as possible. Changes are subject to product availability, staffing, preparation schedules, and approval by Flower Patch.
Additional products or services may require additional payment. Reductions, removals, or cancellations may be subject to restrictions after flowers, supplies, labor, rental items, or other resources have been ordered or reserved.
Cancellation and refund eligibility will be determined according to the terms stated in your proposal, invoice, order confirmation, or separate service agreement. If no separate cancellation policy is provided, contact us promptly to discuss available options.

7. Delivery, Setup, and Pickup
Delivery fees begin at the amount stated on our website or proposal and may increase based on distance, order size, venue access, timing, setup requirements, and other logistical considerations.
Customers are responsible for providing accurate delivery information, venue requirements, access instructions, contact details, and event schedules.
Flower Patch is not responsible for delays caused by circumstances outside our reasonable control, including:

• Incorrect or incomplete delivery information

• Restricted venue access

• Venue delays

• Traffic or road closures

• Severe weather

• Accidents

• Carrier or supplier delays

• Government restrictions

• Emergencies or other events beyond our control

Once flowers or other products have been delivered to the agreed location or accepted by the customer, venue, coordinator, or another authorized person, responsibility for their care and protection transfers to the customer.
Additional waiting time, redelivery, relocation, after-hours service, or unplanned setup requirements may result in additional charges.

8. Rental Items
Rental products remain the property of Flower Patch at all times. Rentals must be used only for the agreed event and returned or made available for pickup at the agreed location, date, and time.
Customers are responsible for rental items from the time they are delivered or collected until they are returned to or retrieved by Flower Patch.
The customer may be charged for rental items that are:

• Lost, stolen, or not returned

• Broken or damaged

• Excessively dirty

• Altered, painted, cut, or modified

• Exposed to unsafe conditions

• Returned after the agreed deadline

Replacement, repair, cleaning, retrieval, and late-return fees may apply. Rental pricing does not include flowers, installation, delivery, or pickup unless expressly stated.

9. Customer Responsibilities
You agree to:

• Provide accurate contact, event, venue, and delivery information

• Review proposals, invoices, floral selections, colors, quantities, and event details carefully

• Communicate relevant venue rules, access restrictions, setup times, and removal deadlines

• Obtain any permissions required by the venue

• Provide a safe and accessible environment for delivery and installation

• Make payments by the stated deadlines

• Properly care for flowers and rental products after delivery or pickup

• Notify us promptly of any requested changes or concerns

Flower Patch is not responsible for errors resulting from inaccurate, incomplete, or untimely information supplied by the customer or another party associated with the event.

10. Allergies and Natural Products
Flowers, greenery, plants, floral preservatives, fragrances, and related materials may cause allergic reactions or sensitivities. Customers are responsible for notifying Flower Patch of known allergies or sensitivities before confirming an order.
Flowers and decorative greenery are not intended for consumption unless expressly identified as food-safe and approved for that use. Some flowers and plants may be toxic if ingested by people or animals.

11. Photographs and Portfolio Use
Unless otherwise agreed in writing, Flower Patch may photograph completed floral arrangements, décor, and installations for business, portfolio, website, social media, and promotional purposes.
We will make reasonable efforts not to publish private personal information. If you do not want photographs of your order or event décor used for promotional purposes, please notify us in writing before the event.
Professional photographs supplied by a customer, photographer, planner, or venue may only be used when the necessary permission has been granted.

12. Website Use and Intellectual Property
All website content—including text, logos, graphics, floral designs, photographs, videos, layouts, and other materials—is owned by or licensed to Flower Patch and is protected by applicable intellectual-property laws.
You may use the website for personal, noncommercial purposes. You may not copy, reproduce, distribute, modify, sell, or commercially exploit website content without prior written permission.
You agree not to misuse the website, interfere with its operation, attempt unauthorized access, introduce harmful software, or use it for an unlawful purpose.

13. Email and Text Communications
By providing your email address or telephone number, you agree that Flower Patch may contact you regarding your inquiry, consultation, order, payment, delivery, rental, or event.
If you separately consent to receive promotional emails or text messages, Flower Patch may send information about services, offers, planning reminders, and other marketing communications.
Consent to receive marketing messages is not required to purchase products or services. Message frequency may vary, and message and data rates may apply. You may opt out of marketing text messages by replying STOP and may request assistance by replying HELP. You may unsubscribe from marketing emails using the unsubscribe link included in the message.
Opting out of promotional communications does not prevent us from sending necessary service-related communications about an active inquiry, order, rental, or event.
Carriers are not responsible for delayed or undelivered messages.
14. Third-Party Services and Links

Our website may use or link to third-party platforms for payments, forms, maps, social media, scheduling, analytics, or other functionality.
Flower Patch does not control and is not responsible for the availability, security, content, privacy practices, or performance of third-party services. Your use of those services may be governed by separate terms and privacy policies.

15. Disclaimer of Warranties
To the fullest extent permitted by law, the website, products, and services are provided on an “as available” basis.
Because flowers are natural and perishable products, Flower Patch does not guarantee that flowers will remain fresh for a specific period after delivery or pickup. Flower longevity depends on the flower variety, handling, temperature, hydration, weather, and environmental conditions.
Flower Patch does not guarantee that the website will always be available, uninterrupted, secure, or free from errors.

16. Limitation of Liability
To the fullest extent permitted by law, Flower Patch will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the website, products, rentals, delivery, installation, or services.
If Flower Patch is found liable for a claim, our total liability will not exceed the amount paid by the customer for the specific product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

17. Indemnification
You agree to indemnify and hold harmless Flower Patch and its owners, employees, contractors, and representatives from claims, losses, damages, liabilities, and reasonable expenses arising from:

• Your misuse of our website, products, or rental items

• Your violation of these Terms

• Inaccurate information or instructions supplied by you

• Damage caused after delivery, pickup, or acceptance

• Your violation of applicable law or the rights of another person
   

18. Force Majeure
Flower Patch will not be responsible for a delay, substitution, interruption, or failure to perform caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fire, illness, labor disruption, supplier shortages, transportation delays, government action, utility outages, or other emergencies.
When reasonably possible, we will communicate with you and work toward an appropriate alternative solution.

19. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
Any legal action arising from these Terms or our services will be brought in a court of competent jurisdiction located in Utah, unless applicable law requires otherwise.

20. Changes to These Terms
We may update these Terms periodically. Updated Terms will be posted on our website with a revised effective date.
Changes apply prospectively from the date they are posted and do not replace the specific terms of an existing signed agreement unless agreed to in writing.

21. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

22. Entire Agreement
These Terms, together with the applicable proposal, invoice, order confirmation, rental agreement, event agreement, and Privacy Policy, constitute the agreement between you and Flower Patch concerning the applicable website use, order, or service.
If a signed agreement conflicts with these general Terms, the signed agreement will control for the applicable order or event.
